These Terms of Service govern your use of EyeDea and EyeRys, desktop applications developed and distributed by EyeDa Group. Please read them carefully before using our software.
Acceptance of Terms
By downloading, installing, or using EyeDea or EyeRys, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our applications.
These terms apply to all versions of EyeDea and EyeRys, including any future updates or releases, unless a separate agreement is provided at the time of release.
License to Use
EyeDa Group grants you a free, perpetual, non-exclusive, non-transferable license to use EyeDea and EyeRys for personal, non-commercial purposes on devices you own or control. Because our applications run entirely on your device, this license is not subject to revocation once you have obtained a copy.
This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit our applications or any content within them.
Restrictions
You agree not to:
- Copy, modify, distribute, or create derivative works based on our applications without written permission
- Reverse engineer, decompile, or disassemble any part of our applications
- Use our applications for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to any systems or networks connected to our applications
- Remove or alter any proprietary notices, labels, or marks on our applications
Disclaimer of Warranties
Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied. EyeDa Group does not warrant that the applications will be error-free, uninterrupted, or free of viruses or other harmful components.
We make no representations or warranties regarding the accuracy, reliability, or completeness of any content or functionality provided by our applications.
Limitation of Liability
To the fullest extent permitted by applicable law, EyeDa Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our applications, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from your use of the applications shall not exceed one hundred dollars (USD $100), or the maximum amount permitted by applicable law.
Updates & Changes
We may release updates, patches, or new versions of our applications from time to time. These updates may modify or remove features. We are not obligated to provide updates, but any updates you install will be subject to these terms unless a separate agreement accompanies the update.
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our applications after changes are posted constitutes your acceptance of the revised terms.
Discontinuation
Because EyeDea and EyeRys run entirely on your local device, EyeDa Group cannot revoke access to copies you have already installed. However, we reserve the right to discontinue development, stop distributing new versions, or remove downloads from our site at any time without notice.
If you violate these terms, your right to use the applications under this license terminates. Provisions of these terms that by their nature should survive termination will remain in effect.
